📋 Terms of Service

These Terms of Service ("Terms") govern your use of the Nomad Chat platform operated by The Moving Nomad ("we", "our", or "us"). By creating an account or using our services, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Nomad Chat, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the service.
2. Description of Service
Nomad Chat is an AI-powered customer support platform that provides:
- AI chatbot widget for websites (Shopify, WooCommerce, and custom sites)
- Live chat and handoff capabilities
- Lead capture and management
- Website crawling and knowledge base compilation
- Analytics and reporting
- Multi-user management (Super Admin, Admin, Agent roles)
3. Account Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must be at least 16 years of age to create an account
- One person or legal entity may not maintain more than one free account
- You are responsible for all activity that occurs under your account
4. Acceptable Use
You agree NOT to use Nomad Chat to:
- Violate any applicable laws or regulations
- Send spam, phishing, or misleading content through the chatbot
- Collect personal data from website visitors without proper consent
- Distribute malware, viruses, or any other harmful code
- Impersonate any person or entity
- Reverse engineer, decompile, or attempt to extract the source code
- Use the service in any way that could damage or overburden our infrastructure
- Resell or redistribute the service without written permission
5. Subscription and Payments
- Nomad Chat offers free and paid subscription plans
- Paid plans are billed monthly or annually as indicated at the time of purchase
- Payments are processed through secure third-party providers (Stripe, PayPal)
- Prices are subject to change with 30 days' notice
- Refunds are handled on a case-by-case basis within 14 days of purchase
6. Your Content
You retain ownership of all content you upload or generate through Nomad Chat, including:
- Website content crawled and indexed for the AI knowledge base
- Chat conversations and customer interaction data
- Lead information and contact details
- Customizations and configurations
You grant us a limited license to process and store this content solely to provide the Nomad Chat service.
7. AI and Chatbot Responses
Important: AI-generated responses are based on your website content and may not always be perfectly accurate. You are responsible for reviewing and monitoring chatbot interactions. Nomad Chat is not liable for any decisions made based on AI-generated responses.
8. Service Availability
- We aim for 99.9% uptime but do not guarantee uninterrupted service
- We may perform scheduled maintenance with reasonable advance notice
- We are not liable for downtime caused by factors beyond our control
9. Intellectual Property
The Nomad Chat platform, including its design, code, features, and branding, is owned by The Moving Nomad and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without permission.
10. Limitation of Liability
To the maximum extent permitted by law:
- Nomad Chat is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
- We are not liable for loss of data, revenue, or business opportunities
11. Termination
- You may close your account at any time by contacting us
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your data will be deleted in accordance with our Privacy Policy
- Provisions that by their nature should survive (liability, IP, dispute resolution) will survive termination
12. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or through the platform. Continued use of Nomad Chat after changes take effect constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms shall be resolved through arbitration or in the courts of Kenya.
